States' Rights vs Federalism Battle Heating Up...Again

On the forefront right now is bank regulations, but the HVACR industry is also well-versed in arguments between state vs federal regulatory authority. This article outlines the current debate surrounding the banking industry, but if you read the article and substitute "The National Bank Act" with "The National Appliance Energy Conservation Act" (NAECA), it might as well be about our industry too. In 2007 energy legislation and 2008's beginning of a Dept. of Energy rulemaking, regional efficiency standards is the most direct frontal assault on federal preemption while the potential House climate change bill includes a "multiple metrics" provision which would open the door to states using a wide range of efficiency ratings as standards.
